Passengers will receive all essential information about the package prior to the conclusion of the contract on the package of travel services.
— There is always at least one trader who is responsible for the proper performance of all travel services included in the contract.
— Travelers are provided with an emergency telephone number or contact point details where they can contact the organizing travel agency or the travel agent.
Travellers may transfer the package to another person, following reasonable notification and possibly paying additional costs.
— The price of the package may be increased only if the specific costs increase (e.g. fuel prices) and if this is expressly provided for in the contract, and in any case not later than 20 days before the start of performance of the package, if the price increase is greater than 8% of the package price, the traveller may terminate the contract. If the organizing travel agency reserves the right to increase the price, the traveler is entitled to a price reduction if there is a decrease in the relevant costs.
Travellers may terminate the contract without payment of a termination penalty and obtain a full refund of any payments if any of the essential elements of the package other than the price have changed significantly. If, prior to the start of the package execution, the responsible merchant cancels the package, travellers are entitled to a refund and, where appropriate, to compensation.
Travellers may terminate the contract without payment of a termination penalty, prior to the start of package execution, in exceptional circumstances, for example in the event of serious security issues at the destination that are likely to affect the package.
— In addition, travelers have the opportunity to terminate the contract at any time before the start of the package execution, in exchange for paying an appropriate and justifiable termination penalty.
If, after the start of the execution of the package, important elements of the package cannot be executed as agreed, the passenger will have to be offered appropriate alternative services, without entailing the payment of additional costs. Travelers can terminate the contract without paying a termination penalty, if the services are not performed in accordance with the contract and this substantially affects the performance of the package, and the organizing travel agency does not fix the problem.
Travellers are also entitled to a price reduction and/or compensation for damages in the event that the travel services are not performed or are performed in our proper manner.
— The organizing travel agency must provide assistance if the traveler is in difficulty.
— If the organizing travel agency goes into insolvency, the payments will be refunded. If the company becomes insolvent after the start of the package execution, and the transport is included in the package, the return of the passengers is guaranteed. Wens Tour SRL has contracted insolvency protection with Omniasig Insurance Company Vienna Insurance Group SA, Insurance Policy No. I51609 (validity: 29.06.2018-28.06.2019). For the purposes of this form, “organizing travel agency” means the organizing travel agency established on the territory of Romania or the intermediary travel agency established on the territory of Romania, which directly purchases packages from an organizing travel agency not established in Romania, as the case may be, in accordance with Article 14 of the Government Ordinance no. 2/2018.
In the case of insolvency provisions, the organizing travel agency shall be the one from another Member State or from Romania, as the case may be.
